well between the 83s. traffic is going to be looking all right on the west side at liberty road. it's about a moderate stream of volume, fortunately everything appears to be moving at speed. 5:00. he was rolling down a harford county road when a state trooper pulled him over and he continued to roll. his camera. that led to big problems. here's a guy facing 15 years. abc2 news linda so tells us the whole story. >> reporter: it started as a traffic stop. when the 24-year-old motorcyclist was pulled over for speeding by a state trooper in an unmarked car. anthony grapier first thought he was being robbed and started to videotape them as they gave him a ticket. he then posted the video on youtube. that prompted state police to charge grapier with three felony wiretapping counts. a circuit court judge dropped the cases essentially dismissing the case. grapier says the ruling means

recording police on the job is not a crime in maryland. >> seemingly minor traffic encounter has turned into something that raises very important questions about what it means to live in a democracy. >> the state's attorney has the option to appeal. meanwhile, a spokesman for the state police says if the trooper encounters a video camera in the future they will allow the recording to continue. in the studio, linda so, abc2 news. building inspectors are trying to determine what caused a building to collapse in west baltimore. druid hill avenue and laurens street yesterday afternoon. fire crews were digging for survivors. after police received initial reports a woman was standing near the building when it came down. >> we heard a boom, boom. that was it. my daughter seen it fall. >> are -- after rumbling and

thermal imaging there was no evidence anyone was inside or injured. 5:02. he calls himself a white supremacist and he'll spend 31 years behind bars for a brutal attack on a fisherman. james privotte was fishing in fort armystead when three men approached him. calvin lockner told police he didn't like black people and idolized adolf hitler. in court he expressed some regret. >> he asked for foregiveness through the written statement read by his attorney. >> mr. privotte, 77 years old, suffered a fractured eye socket, temporary blindness, lost some teeth. lockner will serve an additional year for assaulting a correctional officer, throwing a cup of urine and feces in his face while he was

behind bars. a jury in california convicted a man of murder in the drunk driving death of angels pitcher and maryland native nick adenhart. andrew gallo was found guilty of three counts of murder and other charges. he was driving drunk when he hit a car, killing adenhart and two of his friends. he faces 50 years in prison. a 60-year-old is recovering in anne arundel county. police were looking for the driver who hit him. sean hahn was riding his bike with friends over the weekend along sunrise beach road in crownsville. police say that is when he was hit by a maroon gmc sierra pickup truck. hahn is in stable condition. maryland's first casino opened for business. the hollywood casino in perryville is already welcoming guests even though the official grand opening is not until this thursday. inside you'll find 1,500 slots and lots of food and lots of drinks. >> something to make perryville grow a little bit.

bring the people into town. helps lower our taxes a little bit. >> it is exciting. very exciting don't have to drive to delaware anymore. >> the casino created 350 full time jobs. it's open from 8:00 in the morning to 2:00 in the morning everyday. when you want to save money and you're flying you usually check out southwest or airtran for discounts. but your choices are shrinking. sherrie johnson is live at bwi marshall with big changes that could possibly cost you more money. >> reporter: that's right. there's some big news coming from bwi marshall international airport. two major airline carriers known for deep discounts actually plan to merger. southwest airlines says it plans to buy airtran for a reported $1.4 billion. bwi marshall is the airline's largest east coast hub. the two carriers serve 70% of the passengers flying in and out of bwi marshall. the deal will move southwest into 37 new cities and with the

competition of airtran gone some passengers fear the fares will eventually go up. >> we like southwest because they don't charge for the bags. we also fly airtran because of the price. >> it was my first thought when i thought they would merge, losing a competitor. i'm concerned about rates. >> reporter: this deal is expected not to be final until 2012. reporting live from bwi marshall, sherrie johnson, abc2 news. it's 5:05. this is not in the mail. the internal revenue service reportedly will not be mailing out tax forms to us this year. that is because more than 5 million individuals -- 95 million individuals filed returns for 2009 on-line. that is up about six million from the previous year. the irs hopes to save $10 million a year. taxpayers can still get forms at irs.gov or through your local irs offices or at participating libraries and also post offices. come friday, you'll have to go hands-free.

ice cream maker ben & jerry's is soon going to remove the phrase "all natural" following a request from a healthy advocate group. from the center for science in the public interest says the products contain ingredients such as corn syrup and hydrogenated oil. the fda has no formal definition for "natural" and won't object to the term as long as products do not contain artificial color or artificial flavors.

good morning. 5:10. temperatures holding in the low 70s in many spots. a one humid morning and we have more rain approaching the region. right now 72 ocean city and back towards easton. 60s to our west. you can see the defining line of rain. heavy rain from frederick back towards hagerstown, front royal got hit, back towards winchester. that main band is going to slide into the north but there's a line that extends just south of there towards fredericksburg, that is going to reach us as we head through this morning. there's a flash flood watch now for much of maryland, at least the counties west of the bay including harford, baltimore, anne arundel county, howard and carroll county for localized heavy downpours that could produce some street flooding. that is a coastal flood advisory if you're living by the bay. near 70 this morning. we'll break it up a little but still an isolated storm and high of 79 this afternoon. let's check the roads with kim. as you make your way up and down the 95 corridor traffic

moves very well. no problems on 95 southbound from harford county approaching the tunnels. and headed down towards 695 and 895 split. as we look at the drive times, on the harrisburg expressway it's five minutes from shawan to the beltway no problems on the top side between the 83s. on the jfx traffic moves nicely between the beltway down to northern parkway. as we check the camhas here -- cameras here, no problems southbound here headed to the capitol beltway. all the northbound lanes open. we have one accident in middle river that has kingston road closed between eastern boulevard and hawthorne road. police are on scene out there but you can use hawthorne to get around the scene of that crash. 5:11. parents, you're packing your kids' lunch. >> what is in the bag? are your kids going to eat it? we have tips to make sure they do. >> look who was in the audience with "dancing with the stars." i think that's sarah palin. we will find out what she's saying about this competition.

5:15. in your morning "health alert," your kids are i think worn out. after a few weeks in school they are tired of the peanut butter and jelly and bologna but fear not, susan hendricks comes to the rescue. >> move over, chips and bologna, take that, prepackaged snacks. school lunches can be fun and good for you. it only takes a little imagination. >> a good meal consists of four parts. whether it's for a packed school lunch or a dinner. a protein. a whole grain. a fruit or vegetable and a heart-healthy oily fat or nut. there are several great snacks that you can add to your lunch box, one would be these seasonal grapes. the concord grapes are loaded with antioxidants. these little cherry tomatoes taste like candy. slice these in half. they add beautiful color and a sweet flavor.

i recommend you just cut up vegetables because when vegetables are cut up and grabbable and mixed together the children are more likely to eat them. a really fun element of any meal or salad is nuts. it's a great way to get a heart-healthy oil into your diet and into your child's diet but it's also very tasty and crunchy. then we need something to put it all in. a good insulated lunch box with an ice pack inside. to keep it nice and cool. >> reporter: good healthy suggestions for healthy school year. for today's "health minute," i'm susan hendricking. there's a new study that finds that eye problems among baltimore school students may often go uncorrected even though vision screenings are required by law when students come into school in first through eighth grade. a report by the abell foundation says it could leave many kids at a disadvantage in the classroom. baltimore county is showing

we got another active day here as we're dealing with a very stormy weather pattern that will not let up for most of this week. a big transition to much cooler temperatures by this weekend. we should be 74 in the afternoon. 91 -- 94 in 1886. we're focusing on the cooler temperatures as we head into the weekend. sunrise 7:00, down to 6:54. we'll have to see the -- we have warm air pushing into the the area and 71, a muggy start but look at the 60s and 50s to our west. that is separated by one storm and a line of rain now passing through maryland and down through southeast virginia. this is what is going to pivot up in our direction. we're on the warm unstable side of things. area of low pressure to our west will continue to wrap up and bring in drier winds once we head into the afternoon. there's a break in the cloud line, southwestern virginia, that swings through here by lunchtime and the afternoon we

should get sun. overall the big pattern highlights this one big storm dominating the eastern seaboard, once that passes through there's another wave of low pressure that is going to catch the tail end of this boundary and ride back up the east coast. that is going to hit us pretty hard with more heavy rain and possible flooding as we head through thursday. we have a flood watch that extends on in through 8:00 this morning. and band of rain will be swinging its way through. during the morning hours and by this afternoon should be passing across the eastern shore and lifting to our north. we should get some dry air here and sunshine but still an isolated storm that could pop up as we head into the afternoon. look at the tail end of the boundary, stalls just south of ocean city, starts to make a return tomorrow morning. we will start off with sunshine but the clouds make a return and we will have some rain trying to move in by tomorrow night. then watch our forecast model indicating that heavy rain spreading up in our direction by thursday morning and we could have another round of potential flooding and on top of the rain we've just had it could be even worse as we head through thursday, trying out for the weekend. today 79, that's our 2-degree

guarantee but that is the surge of warm unstable humid air. you feel that this morning, even this afternoon with sun and isolated thunderstorm. could still pop out. tonight we slip back down, get the dry air, dropping into the 50s. tomorrow we stay in the low to mid-70s. with early sun. then the clouds return and we'll hold off the rain at least until after dark. let's check the roads with kim brown. >> thank you. around 695 traffic is moving very well on both loops at this time. on i-70 as well. traffic looks good between route 29 columbia pike and the beltway. if problems westbound -- no problems westbound towards i-20 as -- 270, as justin mentioned it will be a little wet to hagerstown. here, no problems from harford county to baltimore city. as you proceed through baltimore county, howard county and to 495 traffic looks well. we're in the green on the outer loop from 795 to i-70. only five minutes. 95 looks good from whitemarsh boulevard to 695. that will take you about three

minutes. on the harbor tunnel thruway, six minutes between the split and 295. though, we are still working one crash in middle river, kingston road closed between eastern boulevard and hawthorne road. back to you. 5:21. legendary actress gloria stuart passed away. she broke into films in the 1930s and made a major comeback in the 1997 james cameron film "titanic." she played the older version of kate winslet's character. she died in her l.a. home sunday. she was 100 years old. she was diagnosed with lung cancer five years ago. wyclef jean is in the hospital after being treated for exhaustion. the 37-year-old hip hop star checked in over the weekend. his rep says the stress and fatigue from his failed bid for haiti's presidency was to blame. the grammy-award winner is expected to be released sometime this week. let's look at week two of "dancing with the stars."

more than a snac i'm frank kratovil and i approve this message. the real andy harris. buried in his website - a promise to replace the tax code with a 23% sales tax and eliminate the mortgage interest deduction. a bush tax panel said families would pay $6,000 more a year. a reagan tax advisor calls it a very dumb idea. but that's not his only bad idea. harris was the only senator to vote against expanding the child care tax credit and against the state's cancer treatment program. andy harris' extreme ideas will cost us.

i always feed in the fall. but, it's the best time. feed your lawn in the fall. the fall feeding makes all the difference in the world. what the fall feeding does is build the roots.. that's when the roots sorta want nutrition. i give my lawn scotts winterguard. it's like a root building machine. it builds your lawn from the roots up. next year you get this! the stronger the roots, the stronger the lawn. all year long. the best time to feed is when it will do the most good. there's no substitute for the fall feeding, trust me. it is the best thing you can do for your lawn.
